
As you are probably aware, the New York State sales tax law can be very confusing and hard to interpret. Previously, if a Taxpayer was struggling to determine if the products or services that they offer are subject to sales tax, they were able to write into the Tax Department and ask for written guidance. The Advisory Opinion will state if what they are selling is subject to New York State sales tax.
However, over the years, Office of Counsel has become increasingly more backed up and Advisory Opinions are taking years to be issued. When this started to happen, the Tax Department began allowing Information & Interpretation Requests. This still gave Taxpayers answers to their questions, but were nor precedent setting.
Well, now (except in limited circumstances) the Tax Department is no longer accepting Information & Interpretation requests. They will only respond to Advisory Opinion requests. However, some Advisory Opinion are sitting with the Tax Department for over 5 years without being answered. This is just another instance showing that the Tax Department would rather throw more money into auditing the Taxpayers, than helping the Taxpayers do it correctly.
